I'm not a lawyer by any means..BUT
Say I do images, or Illustration as he puts it..on my Good Images or Illustrations, I spend anywhere from 6 to20 hours working on them. Say my rate is..just picking a number, say a cheap $10/hour. so I spend 6 to 20 hours..that's $60 to $200 for that piece I just worked on and turn around and sell it for $59.99..that's not making a profit is it? I would say NOT..I'm actually losing money. They couldn't come after me that way.."making a Profit".....

I have NEVER Approached ANYONE using my Logo and DEMANDED Any money and told them that if they didn't pay me that I would STOP?. I have never done that. I Do not work in that way. Many people on this PTE Forum Know me and a lot of folks are using MANY of my work. ASK Anyone of them if I have asked them for any moneys for using my WORK. Not one of them will say yes. Many folks I do work for (Cruiser Events, t-shirt Logos) ask me to Create something for them. I have never charged anyone for this. They usually send me a Thank you package (in ways of a Goody Bag with some t-shirts or other stuff but NEVER Any Moneys) Go ahead..ASK Around.
If I see someone using one of my Logos or Drawing WITHOUT My permission, I contect them and ask them to take it off their site cause they never asked my permission. In all cases they turn around and dask me if they can use it. I ALWAYS tell them, now that you ask, YES. NEVER, EVER have I asked ANYONE dfor money to use any of my Work..NEVER.
I would like to find out who this person is so that I can approach them on this. This person(s) is LYING 100 %.
Am I pissed off Yes. Not at you Laney..at whomever told you this. If they are using one of my logos and are badmouthing me like this, I want to know who they are cause they just lost the usage of MY Logo or art work. You would be pissed off too if you were acused of doing something you never did.

I can say what Marc is saying is true. I have asked his permission to use his images and he said YES. NEVER did he ask to for money! He relpy was "Sure, Thank you for asking!"

Laney, I would really like to know who this person is.
I really would like to know why he/she is spreading FALSE Rumors about me.

The ONLY work I ever charge anyone is my work on the Rear Graphics on PT Cruiser Hatches. I spend anywhere from 8 to 24 hours creating those, Burn them on a CD, travel across Toronto to deliver it to the Printers and Only Charge $25 for my trouble. Not once have I DEMANDED that they PAY me or Else..NOT Once

Marc is telling you the truth. he designed my logo, which is on the entrance of my site and also on a few t-shirts that I have...uh.... given away for ...uh donations...
It came out so well on the t-shirts that I sent Marc one as thanks. He never did ask for any money. First package that I have ever sent out of the USA !

As I said, i am Not upset at you.
You don't know me. I seldemly get upset. I am always willing to help the next guy. But when someone tells another False information about someone, especially if that someone is using my artwork, then I start to get ticked. I have many friends on this Forum and they know my work. when and if they see some Artwork that looks like mine, a few of them will email me and ask me if it is indeed my work. I always check it out and if is my work and I do not recall anyone asking me for my permission (which i always grant by the way), then I approach them and ask them why they are using my work since they never contacted me. Most time they always come with an excuse but some do appologize and ask me to use it. i've always said "OK". I then tell them that they may use it BUT they are NOT to sell anything with it to make a Profit. That is all I ask of them. I never ask anyone, not one of them to pay me, or bribe them in any way. That is just NOT TRUE.

Laney, the word will get around to me sooner or later. If this person is spreading False info about me, he's probably told a few people. The word will get back to me sooner or later.

Actually, what they did was trademark it, not copyright it. If you create something, you automatically have a copyright, but if you use a name or phrase or image in trade, you'd better get a trademark (at your own expense) with the US Patent and Trademark Office or someone will likely get one and then you'll be SOL.

A friend of mine lost his business name after he established it as a business and licensed it in the state of Pennsylvania but did not trademark it--yep, another company trademarked it without his knoweldge and they sued him immediately!

I've been wrangling with the PTO to trademark the name of my Webzine and it's taken 2 1/2 years, cost me over $400, and I'll probably have it denied again. You gotta love it.

Folks, if the attack lawyers come after you, cease and desist. They mean business and they will sue and you will lose. That's the awful truth.
