Default Man Who Killed Armed Intruder Jailed Eight Years

Am I missing something here? Armed men break invaded his home, he defends himself and is jailed?

A man who stabbed to death an armed intruder at his home was jailed for eight years today.

Carl Lindsay, 25, answered a knock at his door in Salford, Greater Manchester, to find four men armed with a gun.

When the gang tried to rob him he grabbed a samurai sword and stabbed one of them, 37-year-old Stephen Swindells, four times.

Mr Swindells, of Salford, was later found collapsed in an alley and died in hospital.

Lindsay, of Walkden, was found guilty of manslaughter following a three-week trial at Manchester Crown Court.

He was sentenced to eight years’ imprisonment.

After the case, Detective Chief Inspector Sam Haworth said: “Four men, including the victim, had set out purposefully to rob Carl Lindsay and this intent ultimately led to Stephen Swindells’ death.

“I believe the sentences passed today reflect the severity of the circumstances.”

Three other men were charged with robbery and firearms offences in connection with the incident, which took place in February last year.

I must be missing something here also,,,,,,,,,,Just what the hell is happening in the world today if you cannot defend yourself against ANYONE at ANYTIME.........I guess I'll be going to jail if someone tries to break into my house,,,,, I will shoot them

The robber is called "the victim"? I guess the homeowners mistake is that he didn't get all 4. I hope he appeals - this is ridiculous.

THe Judge must been a Canadian judge

Here you can get huge trouble for defending yourself in your home. I know that a few people ended up with murder charges over crap like that.. The police expect you to dial 9-1-1

sounds like England to me, you have no right to self defense over there. A farmer who had a history of being robbed, shot and killed an intruder with a shotgun, and was sentenced to life in prison. It was later reduced, but still the message sent is the same.

It's a little thing but "...to find four men armed with a gun." Were all four of them holding onto it together?!?!

Arm-chair editor fix gotten so back on topic...

I'm guessing by the names and titles this took place in Canada or England. So understand their self-defense laws may not be as generous as those we have here in the US. And even then it differs from state to state. It may be that there was no evidence of a struggle inside the residence and the stabbing could have taken place outside in the dooryard or he may have chased them into the alley where they found the fella after he bled out. In some states here in the US you wouldn't be charged with a criminal offense if you stabbed them on your front porch as they tried to come in while in others the attackers have to be fully inside your home before you can use deadly force without repercussions.

All depends on where ya live mate.
